A duly posted meeting of the Zoning Board of Appeals was held at the
Shelburne Town Hall, 51 Bridge St., Shelburne.
Present: Ted Merrill, John Taylor, Lowell Laporte, Catherine Smith,
Bill Sweeney
Absent: Laurie Bluver-MacLeod, Joe Palmeri,
Chairman Pro Tem Ted Merrill opened the meeting at 7:13pm.
Mail was reviewed. Correspondence included a letter from the District
Attorney outlining their findings relative to alleged Open Meeting and
Minutes violations. The letter summarized that the ZBA was found
to have been in compliance with Open Meeting Law. A request
for extension was received from Michael Bolio. Other mail were
program invitations and newsletters.
The minutes of the May 15, 2007 meeting were read and accepted.
The Board met with property owner Norman Davenport relative to questions
about reconstructing a dwelling at 111A Tower Road following a fire. The
dwelling will likely be demolished and rebuilt on the same lot but the
lot is non-conforming. The board referred questions to the
Building Inspector if the dwelling was to be reconstructed on the same
location, and suggested the owner may need to or wish to apply for a
Section 6 permit from the ZBA if the location is to be changed.
In response to the letter from Michael Bolio requesting an extension
of his Special Permit and Variance granted 08/04/2005 the following action
was taken:
Sweeney moved to grant the extension of the Special Permit and Variance
for 1 year subject to review by Town Counsel. Taylor seconded. After
discussion, and further review of the bylaws, and questions Sweeney moved
to lay the matter on the table. The motion to lay the question
on the table was voted unanimously. Taylor will provide the letter
to the Chair and Counsel for more information.
Town Clerk Beverly Neeley met with the board to discuss questions about
making minutes available. After lengthy discussion there
was mutual agreement that: 1) the ZBA will provide to the Town Clerk
minutes for her to make available at Town Hall; 2) one past year of minutes
will be provided and new minutes will be provided once approved; 3) the
Town Clerk will be responsible for letting people review them and copy
them as needed for no fee; 4) if additional information or documentation
is needed the Town Clerk will ask the interested party to contact the
ZBA Chair.
The Board discussed the Town Web Site and the ZBA page. Taylor
moved that the ZBA post the prior 12 months of meeting minutes on the
web site, add the zoning map (such as it is), and update the submission
form so that instructions are included. Merrill seconded and it
was voted unanimously.
Motion to close the meeting at 9:04pm. So voted.
