Zoning Board of Appeals — Meeting Minutes — September 6, 2007—7:00 p.m. — Shelburne Town Hall

A duly posted meeting of the Zoning Board of Appeals was held at the Town Clerk’s Office, 51 Bridge Street, Shelburne.

Present: Joseph Palmeri, Lowell Laporte, John Taylor, William Sweeney, Ted Merrill

Absent:  Catherine Smith, Laurie MacLeod 

Chairman Joseph Palmeri called the meeting to order at 7:10pm. 

Palmeri reviewed mail including a letter from the Board of Selectmen Chair Joseph Judd encouraging work on zoning revisions, renewal offer from the Massachusetts Federation of Planning and Appeals Boards, and invitations to upcoming meeting and classes, and an application for Special Permit from Noah Grunberg of Gardner Avenue relative to the demolition and reconstruction of a portion of his dwelling. 

Palmeri reported that he set the hearing date for the Grunberg special permit request for October 4, 2007 at 7:15pm.  The Board concurred.  A site visit will be conducted on October 2, 2007 at 5:00pm. 

The board re-visited prior discussions about Chapter 40A Section 6 (changing a non-conforming use/structure), and that a formal hearing process is not required but it is recommended, and since Shelburne does not specifically require a Special Permit in this case the vote is a simple majority for a Section 6 permit, and legal advice thereon.

Minutes of the 7/5/07 and 8/2/07 meetings were reviewed and adopted unanimously, after so moved by Merrill and seconded by Laporte..

The board continued previous discussions about the Open Meeting Law and records retention.  There was consensus that we would continue to post minutes on the web site, that meeting minutes would be released within a reasonable time frame, and also copies provided to the Town Clerk once approved for ease of distribution. 

Palmeri moved to adjourn, seconded by Laporte, and it was so voted at 8:45pm.
