Zoning Board of Appeals — Meeting Minutes — November 1, 2007

A duly posted meeting of the Zoning Board of Appeals was held at the Selectmen's Office, 51 Bridge Street, Shelburne.

Present: Joseph Palmeri, Lowell Laporte, John Taylor, William Sweeney, Ted Merrill,

Absent: Laurie MacLeod, Catherine Smith

Chairman Joseph Palmeri called the meeting to order at 7:00pm.

Mail was reviewed.

Reviewed and approved minutes of the 10/4/07 meeting with one edit, and the 10/4/07 hearing for Grunberg with the correction of wording to refer to a "new addition" as opposed to a "new dwelling". Minutes approved as corrected.

The Chair recessed the regular business meeting at 7:30pm for the purpose of conducting a hearing on the request for finding submitted by Brandon Boucias on behalf of James Smith to permit them to renovate an existing non-conforming dwelling at 19 Water Street. Refer to the Hearing minutes for summary and actions.

The regular meeting was reconvened at 8:05pm.

Palmeri reviewed an invitation to a joint meeting of the Planning Board and ZBA, which has been posted on our behalf by the Planning Board for 11/5/07 at 7:00pm. This meeting is to discuss the potential revision of the Town's zoning bylaws. The board revisited items that it felt should be clarified or addressed in a revision. The list included: parking clarifications, definitions section, new use table, Special Permit rules and regulations, and a better map. The board felt of lower priority were the topics of site plan review and cluster zoning changes, and the consensus is that if the latter more "controversial" items were going to prevent the Town from updating the bylaws those additions should be physically split from the remainder of the proposal. Palmeri agreed to send a memo to the Planning Board with a list of this Board's observations (attached).

Merrill moved to adjourn, seconded by Laporte, and it was so voted at 8:55pm.
