Zoning Board of Appeals — Meeting Minutes — January
3, 2008

A duly posted meeting of the Zoning Board of Appeals was held at the
First Floor Meeting Room, 51 Bridge Street, Shelburne.
Present: Joseph Palmeri, Ted Merrill, Lowell Laporte, John Taylor, William
Sweeney
Absent: Laurie MacLeod, Catherine Smith
Chairman Joe Palmeri opened the meeting at 7:05pm.
Mail was reviewed. Discussion concerned last month's letter from the
Registry of Deeds specifying how documents must be formatted to be usable
for their scanning system in the future. The board consensus was that
we would strive to include the requested 3" by 3" white space
in the upper right corner of an 8.5" by 11" page on any of
our documents for the Registry.
The board reviewed a Request for Special Permit submitted by Jessica
Murrow of 35 Mechanic Street to operate a Bed & Breakfast. The board
discussed that the submission lacked detail on the proposal and whether
the Board can or should reject the application until it is deemed a "complete
submission". The consensus was that it was any applicant's responsibility
to provide sufficient detail no later than the hearing date or risk a
rejection of the request. The Clerk was directed to advise the applicant
about additional details which could/should be submitted. With consent
of the Board, the Chair will set the public hearing date for February
7, 2008 at 7:30PM.
The board met with Attorney Kevin Parsons representing Gitsis Realty
LLC for a preliminary discussion regarding the re-construction of the
Stebbins Block (+/- 35 Bridge Street). The block was extensively damaged
by fire in December 2007 and has been demolished. Parsons explained the
owners are contemplating reconstruction versus sale of the lot, and that
to make the project financially feasible any reconstruction plans would
likely require action from the ZBA. Specifically there was discussion
on sections 10.1.2 and 10.1.3 and whether one or both sections may apply,
and review of setback and height restrictions in the current zoning bylaws.
The Board made no decisions or votes in regard to the matter.
The Board reviewed and voted to approve the minutes of the 12/6/07 meeting.
A joint meeting of the Planning Board and ZBA was scheduled for 12/13/07
but the meeting was canceled due to snow. The next meeting is scheduled
for January 10 at 7PM concurrently with the Planning Board's regular
meeting. As it was unclear whether the meeting has been posted jointly,
the Clerk will ask the Town Clerk to specifically post a ZBA meeting
for that time and place.
Brief discussion was held on the status of the bylaw review project,
the chances that changes would be ready for the 2008 Annual Meeting,
and suggestions on priority items for which those who attend the meeting
on January 10 should advocate.
Merrill moved to adjourn, seconded by Taylor, and it was so voted at
9:12 pm.
