Zoning Board of Appeals — Meeting
Minutes — June 5, 2008
Selectmen's Office
A duly posted meeting of the Zoning Board of Appeals was held at the
Selectmen's Office, at 51 Bridge Street, Shelburne.
Present: Joseph Palmeri, Ted Merrill, John Taylor, William Sweeney,
Catherine Smith, Lowell Laporte
Absent: Laurie MacLeod
Chairman Joe Palmeri opened the meeting at 7:07pm.
The board briefly discussed the status of the bylaw revisions approved
at Town Meeting and when they take effect. The Town Office staff provided
copies of the new bylaws to all members present.
At 7:15PM Palmeri recessed the meeting for the purpose of continuing
the public hearing on the Special Permit of Jessica Murrow to operate
a Bed & Breakfast (see hearing minutes). At 7:20PM Palmeri called
the regular meeting back to order. The Murrow hearing was continued once
again until 7:30PM on June 12, 2008.
Palmeri briefly reviewed a sample job description for a Clerk/Clerical
position, which the Selectboard provided for the ZBA's review. The Selectboard
included money in the FY2009 budget for two boards to hire clerical support.
At 7:30 Palmeri recessed the meeting for the purpose of conducting a
public hearing on a Request for Variance submitted by Terry Kimball of
Old Albany Road (see hearing minutes). At 9:30PM Palmeri called the regular
meeting back to order following the close of the Kimball hearing.
The board reviewed the proper method of contacting Town Counsel: only
with approval of the Chair, who must gain approval from the Selectboard.
The Clerk pointed out that the Board has not been specifically criticized
for prior work but as the legal budget is reportedly expended it was
important to review the procedure.
The Board reviewed and voted on prior minutes:
Merrill moved and Sweeney seconded approval of the 3/12/08 Hearing minutes.
So voted unanimously.
Sweeney moved and Merrill seconded approval of the 2/7/08 Meeting and
Hearing minutes. So voted unanimously.
Sweeney moved and Taylor seconded approval of the 3/28/08 joint information
meeting minutes. So voted unanimously.
Taylor moved and Merrill seconded approval of the 3/31/08 joint information
meeting minutes. So voted unanimously.
Sweeney moved and Smith seconded approval of the 4/3/08 Meeting minutes.
So voted unanimously.
Merrill moved and Smith seconded approval of the 5/8/08 Meeting and
Hearing minutes. So voted unanimously.
The board received the Town's new record distribution policy from the
Selectboard. The board will review and discuss further.
The Clerk reported on a record request submitted by Beth Simmonds, who
requested all records of any contact between the ZBA and Town Counsel
for the past year. The Chair provided appropriate information to Simmonds.
The Chair advised that he will schedule and post a meeting of the Board
for 6/12/08 at 7PM at Town Hall.
Merrill moved to adjourn, seconded by Smith, and it was so voted at
10:20 pm.
