Zoning Board of Appeals — Meeting Minutes — November 13, 2008

A duly posted meeting of the Shelburne Zoning Board of Appeals was held at the Selectmen's Meeting Room at Town Hall, 51 Bridge Street, Shelburne, on November 13, 2008.

Members Present: John Taylor, Lowell Laporte, Catherine Smith, Theodore Merrill
Members Absent: Laurie Bluver-MacLeod, Joseph Palmeri, William Sweeney

Clerk John Taylor called the meeting to order at 7:05pm. The Board selected Theodore Merrill to serve as Chair of the meeting.

The Board reviewed the minutes of the 11/6/08 meeting. Taylor moved to accept the minutes of the meeting as printed, Laporte seconded. Minutes were accepted unanimously.

The request for Variance for Richard Broadhurst was again tabled awaiting his request for withdrawal without prejudice. Taylor moved, Laporte seconded and it was so voted unanimously.

At 7:13pm Merrill recessed the meeting in order to continue the public hearing on the application of Industrial Tower and Wireless LLC for a Special Permit to replace their existing tower off Tower Road.

At 7:18pm Merrill brought the meeting back to order, with the public hearing continued until 11/20/08 at 7:15pm at Town Hall.

In response to the decision to continue to the public hearing due to the absence of one member of the Board, Trevor Mackie, who is a member of the Charlemont Planning Board suggested the Board look into accepting the practice of taping a hearing for one member who was absent. He advised Charlemont has accepted this practice. The members thought it would be good to see if this can be done in Shelburne.

The Board met with Faye Whitney who was recently hired by the Town to provide administrative support to the ZBA and the Board of Health. The Board and Whitney discussed many topics including minute-taking, mail, letters, postings, hours available, and the need to communicate and coordinate well with the others in Town Hall.

There was discussion on the home-based business section of the current bylaws and the Board briefly reviewed a draft for a bylaw section on the topic, gleaned from the 2006-07 zoning meetings. The Board will discuss at a future meeting whether that draft or something else should be submitted to the Planning Board for action.

Laporte moved to close the meeting a 7:52pm, Smith seconded, and it was so voted unanimously.
